Applicants who are determined not eligible to sit for the examination (for any reason),
who fail the exam, or participants who fail to maintain eligibility to participate in
the demonstration project,
will have an opportunity to protest that decision.
SSA's action in response to the protest will be final and not subject to appeal.
Protesting An Unfavorable Action by SSA
If SSA takes an action such as denying your application or suspending your eligibility to
participate in the demonstration project and you think that action is wrong,
you may submit a protest
in writing to SSA. Your protest must be postmarked no later than 10 calendar days,
or in the case of a suspension because your insurance lapsed, 15
calendar days from the start of the notice of unfavorable action. It will be
your responsibility to provide any factual information and documentation to support your protest.
The notice informing you of the unfavorable action will provide specific information about
the protest process that should be followed in your case.
You will be notified of the action taken by SSA on your protest within three weeks of its receipt. SSA’s action in response to a protest will be final and not subject to further review.
