are reconvened in Case No. SAC-48001, wherein Mr. Francisco Alvarez
seeks reconsideration of his claim for Workers’ Compensation
Benefits. (PAUSE) (Listen)
Such request is based on claimant’s assertion
that he sustained an injury while in the employ of Zenith Delivery
Company on June 3rd of last year and that said injury
was improperly diagnosed by the Qualified Medical Evaluator.
(PAUSE) (Listen)
Mr. Alvarez, have you had a chance to
review the documents contained in your file—which I will consider
in making my determination—and do you have any objections to my
considering any or all of them?

Buenos días, Señor Juez. Sí, he tenido la oportunidad de repasar

En cuanto me accidenté informé a mi mayordomo; también llené

out if there are any objections on your part to my considering the
information contained in the documents you’ve reviewed. |

tells me the facts of the case, as he understands them, do you wish
to make an opening statement? |

(Listen) Thank
you, Your Honor. I only wish to state for the record that the Qualified
Medical Evaluator who rated Mr. Alvarez’s injuries was one of his
own choosing. (PAUSE) (Listen)
Dr. Wells found that Mr. Alvarez had sustained
an injury to his left wrist and his right ankle and ascribed him a
permanent disability rating of 12.5%, which we feel is appropriate.

No sólo eso, sino que al caer, me dí contra la horquilla
del montacargas y la cuchilla me cercenó parte del tendón; por eso
no puedo caminar muy bien. |

state for the record that I have before me Form 102, which is the
Summary Rating Determination, precisely the document which is in dispute
here. (PAUSE) (Listen)
Having reviewed it in chambers before this hearing, I do find that
the examining physician failed to completely address all issues and
that the rating was, therefore, incorrectly calculated. |

Honor, if you will grant us a brief continuance, I could have further
discussions with Mr. Alvarez regarding this matter. (PAUSE) (Listen)
We just might reach an agreement as to the extent of his injuries,
in which case, rather than continuing with the adjudication of claim
hearing, we would file a Compromise and Release petition. |

In the meantime, the parties might want to look into the availability
of other benefits for the claimant, such as State Disability Insurance
